The court case of whether or not a Jaffa Cake was a biscuit or cake was decided upon by virtue that a biscuit goes soft when stale and a cake goes hard. Jaffa Cakes go hard, therefore it was deemed to be a cake, and as a cake did NOT attract Value Added Tax (V.A.T) . V.A.T is added to all goods unless they're deemed "essential". So groceries like fruit and vegetables do not attract V.A.T. for example, but a chocolate bar or indeed biscuits would. I guess it says alot about us brits that we deem cake "essential" lol. This V.A.T law also caused controversy recently when menstrual pads were declined as an essential item. ๐ณ
